General Terms and Conditions of Sale
1. Introduction
These General Terms and Conditions of Sale (GTC) govern the contractual relations between Astrid Bardelaye, a company registered in the Swiss trade register under number [Registration number to be received shortly], having its registered office at Quai des Bergues 23 - 1201 Geneva - Switzerland, and any natural or legal person (hereinafter the "Customer") making a purchase on the website www.astridbardelaye.com (hereinafter the "Site"). By placing an order on the Site, the Customer unconditionally accepts these GTC.
2. Products
The Site offers books and various items for sale (hereinafter "Products"). The essential characteristics of each Product are described on their respective page. The images on the Site are provided for information purposes only and do not constitute a contractual commitment. The seller reserves the right to modify the offer of Products at any time.
3. Prices
All prices of the Products indicated on the Site are expressed in euros (€) and include the applicable value added tax (VAT). Delivery costs are not included in the price of the Products and will be added to the total amount when the order is validated.
The seller reserves the right to modify the prices of the Products at any time. However, the Products will be invoiced on the basis of the rates in effect at the time of validation of the order.
4. Order
The Customer may place an order on the Site by selecting the desired Products and following the order process. Any order placed by the Customer constitutes an offer to purchase the selected Products in accordance with these General Terms and Conditions.
The order is considered accepted as soon as the Customer receives a confirmation e-mail sent by the seller. The seller reserves the right to refuse any order in the event of an existing dispute with the Customer, insolvency of the Customer or for any other legal reason.
5. Payment
Payment for the Products may be made by the means indicated on the Site. Full payment must be made before the Products are shipped.
In the event of non-payment or payment incident, the order will be automatically cancelled and the Customer will be informed by e-mail.
6. Delivery
6.1 Delivery areas
The Products are delivered to Switzerland, France and other countries according to the conditions indicated on the Site.
6.2 Delivery time
The delivery time varies depending on the destination and the chosen delivery method. The seller strives to ship the Products within 5 working days of receipt of payment. Delivery times are provided for information purposes only and do not constitute a contractual commitment.
6.3 Delivery costs
The delivery costs are the responsibility of the Customer and are calculated according to the chosen delivery method and the destination. These costs are clearly indicated before the order is validated.
6.4 Liability in the event of loss of parcels via the "Livres et Brochures" offer from La Poste
Shipments made via the "Livres et Brochures" offer from La Poste do not benefit from tracking, insurance or compensation in the event of loss, theft or damage to the parcel. By choosing this shipping option, the customer accepts the specific conditions of this mode of transport, which does not allow shipments to be traced and offers no guarantee in the event of non-receipt.
Responsibility of the sender:
Astrid Bardelaye undertakes to prepare and deliver the parcels in perfect condition to La Poste, in accordance with the order placed by the Customer. Once the parcel has been delivered to La Poste, Astrid Bardelaye cannot be held liable in the event of loss, theft or damage to the parcel during transport.
Customer Responsibility:
By opting for the "Livres et Brochures" offer, the Customer assumes the risks associated with this shipping method, including the lack of tracking and the inability to request a refund or compensation in the event of non-receipt of the package. It is the Customer's responsibility to choose a shipping method that meets their security needs.
Astrid Bardelaye recommends that Customers who want a secure shipment, with tracking and insurance, opt for alternative delivery options.
6.5 Export costs
In the context of sales made on the Site, the Customer is fully responsible for all costs related to export, including, but not limited to, customs taxes, import duties, customs clearance fees, and any other charges applicable in the destination country. These costs are not included in the price of the products displayed on the Site and remain the exclusive responsibility of the Customer. It is the Customer's responsibility to inquire about the legal obligations and import costs specific to their country, and to ensure their payment in order to guarantee the proper receipt of their order.
6.6 Receipt of Products
The Customer is required to check the condition of the package upon receipt and to immediately report any damage or anomaly to the carrier. If the Product is damaged, the Customer must inform the seller within 2 days of receipt.
7. Right of withdrawal
7.1 Withdrawal period
In accordance with European law, the Customer has a period of 14 days from receipt of the Product to exercise their right of withdrawal without having to provide reasons.
7.2 Return procedures
To exercise their right of withdrawal, the Customer must inform the seller of their decision by e-mail to abstorius@gmail.com. The Product must be returned in its original condition, accompanied by the invoice, within 5 days after notification of withdrawal. The return costs are the responsibility of the Customer.
7.3 Reimbursement
The refund will be made within 14 days after receipt of the returned Product, provided that the Product is in its original condition. The refund will be made by the same means of payment as that used when ordering.
8. Warranty and Liability
8.1 Legal Warranty
The seller undertakes to provide Products that comply with the description made on the Site. In the event of a defect, the Customer benefits from the legal warranty provided by Swiss law.
8.2 Warranty for items other than books
Certain items other than books may be covered by a specific warranty mentioned on the Product page or in the documentation provided with the item. In the event of a defect or non-conformity, the Customer must contact the after-sales service at abstorius@gmail.com within 14 days of receipt of the Product.
8.3 Limitation of liability
The seller's liability is limited to the amount of the order. The seller cannot be held liable for any indirect or consequential damage, such as loss of income, profits or data, resulting from the purchase of a Product on the Site.
9. Data protection
The seller undertakes to comply with Swiss data protection legislation. Personal information collected from the Customer is used exclusively for processing the order and will not be disclosed to third parties under any circumstances, unless this is necessary for the execution of the order (for example, to delivery services).
10. Applicable law and competent jurisdiction
These General Terms and Conditions are governed by Swiss law. Any dispute relating to the interpretation or execution of these General Terms and Conditions will be subject to the exclusive jurisdiction of the courts of the seller's registered office.
11. Modifications to the GTC
The seller reserves the right to modify these GTC at any time. The GTC applicable to the order are those in effect on the date of the order.
